Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the BIMMONT platform, operated by BIMMONT (“we”, “us”, “our”). By creating an account or using the platform you agree to be bound by these Terms, our Privacy Policy, and any policies referenced herein. If you do not agree, do not use the platform.
1. Service Description
BIMMONT provides a cloud-based (SaaS) workspace for construction process governance, deliverable tracking, and asset register management. The platform comprises three modules:
- Flow — process governance diagrams, role maps, and decision frameworks.
- Index — project deliverable registers (drawings, models, RFIs, submittals) with scheduling and status tracking.
- Repo — physical asset register for equipment, FF&E, and commissioning data.
In addition to the SaaS platform, we may provide consulting, implementation, and training services (“Professional Services”) under separate engagement terms. Where Professional Services are provided alongside platform access, both these Terms and the relevant engagement terms apply.
2. Account Types
2.1 Individual Accounts
Individuals may create a personal account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
2.2 Organization Accounts
Companies, partnerships, and other legal entities may create an Organization (“Workspace”). The person who creates the Workspace becomes its first administrator and represents that they have authority to bind the entity to these Terms. Administrators may invite additional users and assign roles.
3. Beta Disclaimer
The BIMMONT platform is currently in beta. The service is provided on an “as is” and “as available” basis. During the beta period:
- Features, interfaces, and data schemas may change without notice.
- Data entered during beta may be reset or migrated at our discretion.
- We do not guarantee uptime or service-level commitments during beta.
- Beta access may be free of charge or offered at reduced pricing; pricing is subject to change upon general availability.
We encourage you to provide feedback, report issues, and share ideas. Your input directly shapes the product.
4. User Responsibilities
- You agree to use the platform only for lawful purposes and in compliance with applicable laws and industry regulations.
- You will not attempt to access accounts, data, or systems you are not authorized to use.
- You are responsible for the accuracy and legality of data you upload or enter.
- You will not use the platform to distribute malware, conduct denial-of-service attacks, or engage in any activity that degrades the service for others.
5. Data Ownership & Processing
Your data is yours. You retain all rights, title, and interest in the data you submit to the platform (“Customer Data”). We do not claim ownership of Customer Data.
We process Customer Data solely to provide and improve the service. We will not sell, share, or use Customer Data for advertising. Data processing is governed by our Privacy Policy.
Upon account termination, you may request an export of your data. After a reasonable retention period (currently 30 days), we will delete your Customer Data from active systems.
6. Intellectual Property
The platform, its design, codebase, documentation, and branding are the property of BIMMONT and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during your subscription or beta access period.
Feedback, suggestions, and ideas you voluntarily submit may be used by us to improve the platform without obligation to you.
7. Subscription & Payment
During the beta period, access may be provided free of charge. Following general availability, the platform will be offered under subscription plans with defined feature sets and pricing. Payment terms, billing cycles, and cancellation policies will be published at that time. We will provide at least 30 days' notice before any pricing change affects your account.
8. Limitation of Liability
To the maximum extent permitted by applicable law, BIMMONT and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of data, loss of profits, or business interruption.
Our total aggregate liability for any claim arising from these Terms or the platform shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim, or one hundred US dollars (US$100), whichever is greater.
9. Termination
You may close your account at any time through the platform settings or by contacting us. We may suspend or terminate your access if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the service. We will provide reasonable notice except where immediate action is required to protect the platform or other users.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
